1. Agreement to Terms

By accessing or using Email QA Tool ("the Service"), operated at emailqatool.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above. Continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Service Description

Email QA Tool is an AI-powered email quality assurance service. You upload email HTML, and the Service analyzes it for issues across links, UTM parameters, campaign codes, images, alt text, metadata, CSS compatibility, and content quality. The Service can propose and apply inline fixes to your email HTML, and you can download the corrected file.

The Service uses artificial intelligence (Anthropic's Claude) to perform analysis and generate recommendations. AI outputs are assistive in nature and should be reviewed by a human before use in production. We do not guarantee that AI-generated analysis or suggestions are error-free, complete, or suitable for any particular purpose.

3. Accounts

To use Email QA Tool beyond the free trial, you must create an account. Authentication is handled by Clerk. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

You agree to provide accurate information when creating your account. You must notify us promptly if you believe your account has been compromised.

You must be at least 13 years old to create an account. If you are under 18, you must have permission from a parent or guardian.

4. Free Trial

The free trial includes 5 email uploads with all QA checks, inline fixes, and HTML download. After your 5 free emails are used, you must upgrade to a paid plan or purchase an email pack to continue using the Service.

Free trial access is limited to one trial per user. Creating multiple accounts to circumvent trial limits is a violation of these Terms.

5. Payment Terms

Paid plans and email packs are processed through Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis at the applicable rate.

  • Subscriptions. Monthly subscriptions renew automatically until canceled. You can cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period.
  • Email packs. Email packs are one-time purchases, not recurring subscriptions. Purchased credits do not expire.
  • Refunds. Subscription fees are non-refundable for the current billing period. If you experience a technical issue that prevents you from using the Service, contact us at hello@emailqatool.com and we will work with you to resolve it.
  • Price changes. We may change pricing with 30 days notice. Price changes do not apply to the current billing period.

6. Acceptable Use

Email QA Tool is designed for email quality assurance. You agree to use the Service only for its intended purpose: analyzing and improving email HTML before sending.

You agree not to:

  • Upload content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
  • Use the Service to generate, distribute, or facilitate spam, phishing, or malicious email content.
  • Attempt to reverse-engineer, decompile, or extract the underlying algorithms or models used by the Service.
  • Use automated scripts, bots, or scrapers to access the Service in a way that exceeds normal usage patterns.
  • Resell, sublicense, or provide the Service to third parties without our written consent.
  • Interfere with or disrupt the Service, its servers, or connected networks.
  • Circumvent any rate limits, usage limits, or access restrictions.

We reserve the right to suspend or terminate accounts that violate these terms.

7. Rate Limits and Service Quality

To protect service quality and ensure fair access for all users, we enforce rate limits on API calls and email uploads. These limits vary by plan and are designed to accommodate normal usage patterns.

If you consistently exceed rate limits, we may ask you to adjust your usage or upgrade your plan. We will not suspend your account without notice unless the usage pattern indicates abuse.

8. Your Content

You retain all rights to the email HTML and content you upload to the Service. By uploading content, you grant us a limited, temporary license to process it solely for the purpose of providing the QA analysis and inline fixes you requested.

We do not claim ownership of your content. We do not use your content to train AI models. Your email HTML is stored only for the duration of your session and automatically deleted within 24 hours. See our Privacy Policy for details.

9. AI Outputs and Disclaimers

The Service uses artificial intelligence to analyze email content and generate recommendations. You acknowledge that:

  • AI outputs are assistive. They are intended to support your QA process, not replace human review. You are responsible for verifying AI-generated suggestions before applying them to production emails.
  • AI analysis may contain errors. While we strive for accuracy, AI systems can produce incorrect, incomplete, or misleading results. We do not guarantee that the Service will catch every issue in your email.
  • Inline fixes modify your HTML. When you approve an inline fix, the change is applied to your email HTML. Review all changes before downloading and using the corrected file.
  • CSS compatibility scores are based on available data (caniemail) and may not reflect the behavior of every version of every email client.

10. Limitation of Liability

To the maximum extent permitted by law, Email QA Tool and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of revenue, data, or business opportunities arising from use of the Service.
  • Errors or omissions in AI-generated analysis or recommendations.
  • Issues caused by applying inline fixes to email HTML that was subsequently sent to subscribers.
  • Service downtime, interruptions, or data loss.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Indemnification

You agree to indemnify and hold harmless Email QA Tool and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

You may stop using the Service and close your account at any time. To close your account, contact us at hello@emailqatool.com.

We may suspend or terminate your access to the Service if you violate these Terms, engage in abusive behavior, or if we are required to do so by law. Where possible, we will provide notice before termination.

Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation first. If negotiation fails, disputes shall be resolved through binding arbitration.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
